This page, along with the documents it references, outlines the terms and conditions under which we supply any products (“Products”) listed on our website www.herposhak.com (“our website”) to you. Please read these terms carefully before placing any orders. We recommend printing a copy for future reference. If you disagree with any part of these terms, please do not use our website.
1. INFORMATION ABOUT US
1.1. www.herposhak.com is operated by HerPoshak (“we”).
2. SERVICE AVAILABILITY
2.1. We accept orders from customers in Pakistan, the UK, the European Economic Area (EEA), the USA, Asia, and other supported countries (“Serviced Regions”).
3. CUSTOMER ELIGIBILITY
By placing an order, you confirm that:
3.1.1. You are legally able to enter into a binding agreement.
3.1.2. You are at least 18 years of age.
3.1.3. You reside in one of the regions we currently serve.
4. ORDER CONFIRMATION & CONTRACT FORMATION
4.1. After placing an order, you’ll receive an email acknowledging receipt. This does not confirm order acceptance.
4.2. An order is considered accepted only when we send an email confirming dispatch (“Dispatch Confirmation”).
4.3. The sales agreement (“Contract”) applies only to the items mentioned in the Dispatch Confirmation.
4.4. We reserve the right to decline any order for any reason. You agree that all details submitted with the order are accurate.
5. PRODUCT AVAILABILITY & DELIVERY
5.1. Orders will be delivered on or before the estimated delivery date stated in the Dispatch Confirmation, or within 30 days unless exceptional circumstances apply.
6. PRICING & PAYMENT
6.1. Product prices are listed on our website. Delivery fees are calculated separately at checkout.
6.2. Payment must be made using the methods displayed on the website. Orders will be processed once full payment is received.
6.3. Prices may change without notice, but this will not impact confirmed orders.
6.4. Despite our best efforts, product prices may occasionally be incorrect. If an error is found, we will inform you before shipping.
6.5. We are under no obligation to fulfill an order at an incorrectly listed price if the error is obvious and could have been recognized by you.
6.6. Only one discount code can be applied per order.
7. INTELLECTUAL PROPERTY
All intellectual property rights related to the products and content on our website belong solely to HerPoshak.
8. COMMUNICATION
By using our website, you agree to receive communications from us electronically. This includes emails or notices posted on the site, which fulfill any legal requirement for written communication.
9. NOTICES

We may send notices to the email or postal address you provided during ordering. Notices are considered received 24 hours after sending by email or 3 days after posting by mail.
10. TRANSFER OF RIGHTS
10.1. These terms are binding for both parties and their legal successors.
10.2. You may not transfer your rights or obligations without our written permission.
10.3. We may transfer or assign our rights and responsibilities under the contract at any time.
11. FORCE MAJEURE (UNFORESEEN EVENTS)
11.1. We are not responsible for delays or failure to deliver due to events beyond our control (“Force Majeure Events”).
11.2. Such events include but are not limited to natural disasters, wars, strikes, transport issues, or internet/network failures.
11.3. In such cases, contract obligations are paused during the disruption. We will take reasonable steps to minimize the delay.
11.4. Delivery times are estimates and may vary due to third-party courier issues.
12. WAIVER
12.1. If we do not enforce a part of this contract, it does not mean we waive our rights to enforce it later.
12.2. No waiver is effective unless confirmed by us in writing.
13. SEVERABILITY
13.1. If any part of these terms is found to be unenforceable, the remaining sections will remain in full effect.
13.2. Any invalid clause will be interpreted to reflect its original intention as closely as possible under the law.
14. ENTIRE AGREEMENT
14.1. These terms, along with any documents referenced, constitute the full agreement between you and HerPoshak.
14.2. Both parties confirm that no external promises or representations influenced this agreement, unless stated herein.
14.3. No party can claim damages for misrepresentation unless made fraudulently.
15. MODIFICATION OF TERMS
15.1. We reserve the right to change these terms without prior notice due to legal, technical, or business updates.
15.2. You will be bound by the terms in force at the time of your order unless legal changes require immediate application.
16. PROMOTIONS
a) Promotional codes may not be used for sale items unless otherwise specified. Only one code per order is allowed.
b) Flash sale discounts apply only to the specified items and cannot be combined with other promotions.
17. GIVEAWAYS & COMPETITIONS (Instagram)
a) Instagram competitions are open to individuals aged 12 and above, excluding HerPoshak staff and associated parties.
b) Participants must follow the official HerPoshak Instagram account and have internet access.
c) Prizes shown are subject to availability and may be substituted with similar items.
d) Winners are selected randomly and must meet the competition criteria.
e) Multiple entries are allowed unless otherwise stated.
f) No purchase is required unless specified.
g) Deadlines are strictly enforced; late entries will not be accepted.
h) Winners will be contacted privately and may be announced publicly at HerPoshak’s discretion.
i) Winners must share full name, phone number, and address to receive prizes.
j) Prizes are not transferable or refundable and cannot be exchanged for cash.
k) If a prize includes a date, that date cannot be changed.
l) Winners must respond within 24 hours or forfeit the prize.
m) HerPoshak is not liable for technical or delivery delays.
n) Entries violating competition rules may be removed at HerPoshak’s sole discretion.
